By accessing and using the ARI (Audience Resonance Index™) platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.
ARI provides AI-powered cultural analytics and marketing intelligence services that analyze campaign briefs and RFPs to predict campaign effectiveness across multiple metrics.
3.1. You must provide accurate and complete information when creating an account.
3.2. You are responsible for maintaining the confidentiality of your account credentials.
3.3. You are responsible for all activities that occur under your account.
3.4. You must notify us immediately of any unauthorized use of your account.
You agree NOT to:
ARI, the Audience Resonance Index™, and all related technology, algorithms, and proprietary scoring systems are owned by us and protected by intellectual property laws.
You retain ownership of campaign briefs and content you upload. By uploading content, you grant us a license to process, analyze, and use it to provide the Service.
Analysis reports generated by ARI are provided for your internal business use only and may not be resold or redistributed without permission.
6.1. Uploaded campaign briefs are processed using AI and natural language processing technologies.
6.2. We may use aggregated, anonymized data from analyses to improve our algorithms and benchmark databases.
6.3. Your specific campaign data remains confidential and will not be shared with third parties except as required to provide the Service.
7.1. The Service integrates with third-party AI services (including OpenAI) to provide enhanced analysis.
7.2. Use of these services is subject to their respective terms and privacy policies.
7.3. We are not responsible for third-party service interruptions or changes.
8.1. Fees for the Service are based on your selected subscription plan or usage tier.
8.2. All fees are non-refundable except as required by law.
8.3. We reserve the right to modify pricing with 30 days' notice to active subscribers.
8.4. Failure to pay may result in service suspension or termination.
While ARI provides predictive insights, we do not guarantee specific campaign performance outcomes. Analysis results are informational and should not be the sole basis for business decisions.
We strive for 99.9% uptime but do not guarantee uninterrupted service availability.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.
11.1. Both parties agree to keep confidential information disclosed during use of the Service confidential.
11.2. We implement industry-standard security measures to protect your data.
12.1. You may terminate your account at any time through your account settings.
12.2. We may suspend or terminate your access if you violate these Terms.
12.3. Upon termination, your right to use the Service ceases immediately.
12.4. We will retain your data according to our Privacy Policy and applicable laws.
We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use of the Service after changes constitutes acceptance of modified Terms.
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
